End User License Agreement

This agreement is between you and Codinck BV and applies to Drive Index, Slideit and Video Inspo (the "apps"), including their updates. By installing or using an app you accept it. If you don't agree, please don't install or use the apps.

01Your license

We give you a personal, non-exclusive and non-transferable right to install and use the apps, for yourself or for your work, including commercial video productions.

  • You may use the free version of each app on as many of your own devices as you like.
  • You may activate a Drive Index Pro license on the number of computers shown at checkout. Deactivate it on one computer to move it to another.
  • Pro bought in Slideit or Video Inspo works on the devices linked to the Apple or Google account you bought it with, under the rules of that store.

The apps are licensed to you, not sold: Codinck BV and its partners keep all rights in the apps, their code and their design.

02What you may not do

Unless the law explicitly allows it, you may not:

  • sell, rent, lend or sublicense the apps or your license, or share your license key with others,
  • copy, change or translate the apps, or decompile or reverse engineer them,
  • remove or work around the license check or other protections in the apps,
  • remove copyright or other notices from the apps,
  • use the apps for anything illegal.

03Your files and data

Your files remain yours. Drive Index only reads the drives you choose to catalog, to list their folders and files. It does not change or delete anything on them, and the catalog it builds is stored on your own computer.

You are responsible for keeping backups of your data. Our Privacy Policy explains which data the apps send, and to whom.

04Updates and support

We release updates to fix problems and improve the apps, and we provide the updates the law requires to keep them working and secure. Updates may change how features work. We give support by email at info@videomakertools.com, without a guaranteed response time.

05Third-party software

The apps contain open source components that are covered by their own licenses. Nothing in this agreement limits your rights under those licenses.

06Warranty

If you are a consumer, you have a legal guarantee: if an app does not work as described, you have the right to have it fixed or, if that is not possible, to a price reduction or a refund. Beyond that legal guarantee, the apps are provided as they are, without further promises, for example that they will work without interruption or suit a purpose we did not describe.

07Liability

As far as the law allows, we are not liable for indirect damage such as lost profit, lost data or a missed shoot, and our total liability is limited to the amount you paid for the app in the 12 months before the claim. These limits do not apply to damage we cause on purpose or through gross negligence, to death or personal injury, or to rights that consumer law gives you and that cannot be waived.

08Ending this agreement

You can end this agreement at any time by removing the apps. It ends automatically if you break it, and you must then stop using the apps and remove them. Sections that by their nature keep applying, such as liability, survive the end of the agreement.

09App Store and Google Play

If you got Slideit or Video Inspo from the Apple App Store, the following also applies:

  • This agreement is between you and Codinck BV only, not Apple. Codinck BV, not Apple, is solely responsible for the apps and their content.
  • Your license is limited to using the app on Apple devices that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Apple has no obligation to provide any maintenance or support for the apps.
  • If an app fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the apps.
  • Codinck BV, not Apple, is responsible for any claims relating to the apps, such as product liability claims, claims that an app does not meet a legal or regulatory requirement, and claims under consumer protection or privacy law.
  • If a third party claims that an app or your use of it infringes their intellectual property rights, Codinck BV, not Apple, is responsible for investigating, defending, settling and discharging that claim.
  • You confirm that you are not located in a country that is subject to a U.S. Government embargo or that the U.S. Government has designated as a terrorist supporting country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms when you use the apps.
  • Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.

If you got an app from Google Play, the Google Play Terms of Service also apply to your download and purchases.

10Applicable law

This agreement is governed by Belgian law, and disputes go to the courts of Antwerp. If you are a consumer living in the EU, you also keep the protection of the mandatory laws of your own country, and you may take a claim to the courts where you live.
